12 hours
SB 1176
The SB 1176 is a 12-hour alcohol and drug education program required for individuals convicted of a "wet reckless" offense or other reduced DUI charge.
A wet reckless is not a charge you can be arrested for — it results from a DUI plea bargain in which you admit to driving recklessly with a measurable amount of alcohol in your system. This is the shortest state-licensed DUI program available and must be authorized by the court.
3 months
AB 541
The AB 541 is the most common first-offender DUI program, required when a first-time conviction involves a BAC below 0.20% and no chemical test refusal.
The program combines alcohol and drug education, group counseling, and individual face-to-face interviews.
Completion also satisfies the California DMV's requirement for driver's license reinstatement.
6 months
AB 762
The AB 762 is a 6-month program typically ordered for first-time offenders with aggravating factors such as a higher BAC or involvement in a collision. It includes additional group counseling beyond the standard 3-month program and includes two mid-program interviews to monitor progress.
Note: this program has largely been replaced by the 9-month AB 1353 in most courts, but remains available where ordered.
9 months
AB 1353
The AB 1353 is a 9-month program required for first-time offenders whose BAC was 0.20% or higher at the time of arrest, or who refused chemical testing after being detained. It may also be ordered for those with a prior DUI or wet reckless within the past 10 years who plead to a wet reckless.
The program includes an expanded counseling component with three mid-program interviews to monitor progress throughout.
18 months
SB 38
The SB 38 is an 18-month program required for individuals convicted of a second DUI offense within 10 years of a prior DUI or wet reckless conviction.
The program is significantly more intensive than first-offender programs and includes biweekly individual interviews throughout, a structured group counseling schedule, and a re-entry monitoring component during the final 6 months to support the transition back to daily life.
30 months
SB 1365
The SB 1365 is California's most comprehensive court-mandated DUI program, designed for individuals convicted of a third or subsequent DUI offense, or a second DUI with a particularly high BAC.
In addition to education and counseling, the program requires community service hours, a daily journal reviewed tri-monthly, and a 12-month re-entry monitoring phase. The goal is not only accountability but lasting behavioral change and successful reintegration.
